Two caretakers, Yenzile (32) and Admire Ncube (23) have been slapped with 15 months imprisonment each by Matebeleland South Provincial Magistrate, Busani Sibanda after teaming up to flog another caretaker whilst sleeping naked in her bedroom.
Sibanda convicted the two for contravening section 131(1) of the criminal law codification and reform act chapter 09:23 (unlawful entry on premises in aggravating circumstances).
From the sentence, 5 months has been suspended for 5 years on condition the first offender’s do not commit any offence of the similar nature, for which upon conviction, offender is sentenced to imprisonment without the option of a fine.
The remaining 10 months were each wholly suspended and they will both perform community service each 350 hours at Mbuso primary school and 10 weeks at Mbembeswana clinic each.
The court heard that on July 3 of 2025 at around 14:00 hours, the complainant (name supplied) who is also a caretaker saw a neighbour being insulted by fellow caretakers’ children and restrain them from insulting adults.
The children later reported that the complainant restrained them from insulting the neighbour and this did not go down well with the offenders.
On July 4 of 2025 at around 01:00 hours (early in the morning), the offenders proceeded to complainant’s residence, forced her bedroom door open and gained entry where they later shouted against the complainant accusing her of restraining one of the offenders from insulting Linety Ndebele.
They both assaulted the complainant who was in her bedroom several times all over the body while naked using a stick.
The complainant was referred to a hospital where a medical report was compiled leading to the offenders’ arrest.
